Terms and Conditions for "CarbVista"

1. General Information

These Terms and Conditions ("Terms") apply to the use of the CarbVista mobile app, backend services, website, support forms, feedback forms, and related services (together, the "Service").

By using CarbVista, you agree to these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

CarbVista helps users estimate nutritional values from meal photos and manage local meal, diary, and nutrition goal information.

The Service may include:

• AI-assisted meal photo analysis
• Estimated calories, carbohydrates, protein, and fat
• Detected foods, notes, warnings, and confidence indicators
• Local saved meals and diary entries
• User-defined nutrition goals and display settings
• Google Sign-In
• Google Play Billing subscriptions
• Support and feedback forms
• Optional advertising for non-premium users

CarbVista may change, extend, restrict, suspend, or discontinue individual features at any time if this is necessary for technical, legal, security, economic, or product reasons.

3. No Medical, Nutritional, or Professional Advice

CarbVista does not provide medical, nutritional, dietary, therapeutic, or professional advice.

All analysis results are automated estimates. They may be inaccurate, incomplete, delayed, or unsuitable for your individual situation.

You are responsible for checking all values before relying on them. This is especially important if you have diabetes, allergies, medical conditions, dietary restrictions, or other health-related requirements.

Do not use CarbVista as the sole basis for medical, nutritional, medication, insulin, allergy, or health decisions. Always consult a qualified professional where appropriate.

4. AI Estimates and User Responsibility

CarbVista uses automated image analysis and AI-generated output. The accuracy of results depends on many factors, including image quality, lighting, visible portion size, hidden ingredients, preparation method, user-provided notes, model behavior, and technical availability.

You acknowledge that:

• Results are estimates only.
• The app may misidentify foods or portions.
• Values may be too high or too low.
• Warnings may be incomplete or incorrect.
• The app cannot know hidden ingredients unless they are visible or provided by you.

You remain responsible for your own decisions and for verifying information independently.

5. Accounts and Login

CarbVista may require Google Sign-In to use analysis features, receive free analysis credits, access premium features, or manage subscriptions.

You are responsible for keeping access to your Google account secure. CarbVista does not receive your Google password.

You must not:

• Use another person's account without permission
• Provide false or misleading account information
• Attempt to bypass login, quota, billing, or security checks
• Sell, transfer, or misuse access to your account

We may restrict, suspend, or terminate access if we reasonably suspect misuse, fraud, security risks, or violations of these Terms.

6. Analysis Credits, Quotas, and Limits

CarbVista may provide free analysis credits, subscription-based monthly limits, lifetime credits, promotional credits, or other usage allowances.

Credits and limits may depend on account status, subscription status, backend configuration, app version, region, abuse prevention checks, or technical availability.

Unless explicitly stated otherwise:

• Credits have no cash value.
• Credits cannot be transferred, sold, paid out, or exchanged.
• Free or promotional credits may be changed, limited, revoked, or discontinued.
• Premium or subscription limits apply only while the subscription is active and valid.

CarbVista may refuse analysis requests if no valid credits are available, if security checks fail, if the service is unavailable, or if abuse is suspected.

7. Subscriptions and Payments

Paid subscriptions are processed through Google Play Billing. Google's terms, payment rules, refund rules, and subscription management options apply in addition to these Terms.

CarbVista may offer premium features such as higher analysis limits or removal of advertising. The exact benefits may depend on the app version and current product configuration.

You can manage or cancel subscriptions through Google Play:

Cancellation usually prevents future renewal but does not automatically refund previous payments. Refunds are handled according to Google Play's rules and applicable law.

Premium access may end or be restricted if:

• The subscription expires
• Payment fails
• The subscription is cancelled, refunded, revoked, or invalidated
• Google Play reports that the entitlement is no longer active
• Fraud, abuse, or technical inconsistencies are detected

8. Local Data and Backups

CarbVista stores certain data locally on your device, such as saved meals, diary entries, goals, settings, and thumbnails.

Unless explicitly stated, local app data is not guaranteed to be backed up, synchronized, recoverable, or available on other devices.

You are responsible for keeping your device and data safe. Deleting the app, clearing app data, changing devices, or system failures may delete local data permanently.

9. Availability and Changes

CarbVista is provided on an "as is" and "as available" basis.

We do not guarantee that the Service will always be available, uninterrupted, error-free, secure, fast, or compatible with every device, operating system, network, or region.

The Service may be unavailable or limited because of:

• Maintenance
• Backend outages
• AI provider outages
• Google Play, Google Sign-In, AdMob, or billing issues
• Network problems
• Rate limits
• Security checks
• Abuse prevention
• Legal, operational, or economic reasons

We may update, modify, remove, or discontinue features at any time. Where required by law, mandatory consumer rights remain unaffected.

10. Acceptable Use

You must use CarbVista only in a lawful, fair, and reasonable way.

You must not:

• Attack, overload, disrupt, scrape, crawl, reverse engineer, or abuse the Service
• Bypass authentication, billing, quota, subscription, rate limit, or integrity checks
• Automate requests without permission
• Use the backend API outside the official app unless explicitly allowed
• Upload illegal, harmful, abusive, or privacy-invasive content
• Upload images containing personal data of others without permission
• Attempt to extract prompts, models, tokens, keys, configuration, or internal logic
• Use the Service to build a competing service or dataset without permission
• Interfere with advertising, consent, or analytics mechanisms
• Misuse support, feedback, deletion, or account forms

We may block requests, limit functionality, suspend accounts, revoke credits, or take other reasonable measures if misuse is suspected.

11. User Content

You are responsible for any content you submit, including meal photos, optional notes, feedback, support messages, and deletion requests.

You must ensure that you have the necessary rights and permissions to submit such content.

By submitting content, you grant CarbVista the limited right to process it as necessary to provide, secure, troubleshoot, and improve the Service, as described in the Privacy Policy.

You must not submit content that is unlawful, infringing, defamatory, discriminatory, abusive, misleading, or violates the rights of others.

12. Advertising

CarbVista may display advertising to non-premium users, for example in the saved meals area.

Advertising may be provided by Google AdMob and may be subject to consent choices, Google policies, device settings, region, and app configuration.

Premium users may receive an ad-free experience where this is part of the offered premium benefits. This does not prevent system-level, store-level, or third-party content outside CarbVista from displaying advertisements.

13. Third-Party Services

CarbVista may use third-party services such as Google Sign-In, Google Play Billing, Google Play Integrity, Google AdMob, Google's User Messaging Platform, OpenAI, hosting providers, and other technical service providers.

Third-party services may be subject to their own terms, policies, availability, and technical behavior. CarbVista is not responsible for third-party outages, account restrictions, policy changes, payment issues, or service interruptions outside our control.

14. Intellectual Property

CarbVista, including its name, design, app interface, source code, backend logic, texts, images, icons, graphics, and other materials, is protected by copyright, trademark, and other laws where applicable.

You receive a limited, personal, revocable, non-exclusive, non-transferable right to use the app for its intended purpose.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from CarbVista except where legally permitted.

15. Limitation of Liability

To the maximum extent permitted by applicable law, CarbVista and its operator are not liable for damages caused by:

• Inaccurate or incomplete nutrition estimates
• User reliance on AI-generated results
• Medical, dietary, allergy, diabetes, medication, or health-related decisions
• Loss of local data
• Service interruptions or outages
• Third-party service failures
• Unauthorized access caused by user-side security issues
• Misuse of the Service
• Device, network, operating system, or compatibility problems

Nothing in these Terms limits liability where liability cannot legally be limited, including liability for intent, gross negligence, injury to life, body, or health, or mandatory statutory consumer rights.

16. Indemnification

Where legally permitted, you agree to indemnify and hold CarbVista and its operator harmless from claims, damages, costs, and expenses arising from your unlawful use of the Service, your violation of these Terms, your submitted content, or your infringement of third-party rights.

This does not apply where such indemnification is not permitted under applicable consumer protection law.

17. Termination

You may stop using CarbVista at any time. You may delete local app data through the app or Android system settings where available, and you may request account deletion as described in the Privacy Policy.

We may restrict, suspend, or terminate access if:

• You violate these Terms
• We suspect fraud, abuse, attacks, or unauthorized API use
• Continued access creates security, legal, operational, or economic risk
• Required third-party services are unavailable or terminate access

Termination may result in loss of access to credits, subscription-related app access, local or server-side functionality, and stored account-related data, subject to applicable law and the Privacy Policy.

18. Privacy

Personal data is processed according to the CarbVista Privacy Policy:

The Privacy Policy explains what data is processed, for what purposes, and which rights users have.

19. Changes to These Terms

We may update these Terms to reflect legal, technical, business, or functional changes.

The current version will be made available through the app, website, store listing, or another appropriate channel.

If you continue to use CarbVista after changes become effective, you accept the updated Terms, unless mandatory law requires a different process.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, excluding conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods, where applicable.

If you are a consumer, mandatory consumer protection rules of your country of residence remain unaffected.

Where legally permitted, the place of jurisdiction is the competent court for the operator's place of business.

21. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective. The invalid or unenforceable provision will be replaced by a valid provision that comes as close as possible to the intended purpose, where legally permitted.
